La législation ivoirienne sur les défenses à exécution à l’épreuve du droit uniforme de l’OHADA relatif aux voies d’exécution : survivance ou extinction ?

The entry into force of the uniform Acts of OHADA constitutes a source of conflict whith the domestic laws of states since the boundaries of juridiction are not, a priori, easy to mark off. Thus, article 32 of the uniform Act on modes of enforcement would establish the abrogation of the prohibition of provisional execution envisaged under many domestic legislation, a view that would be corroborated by the interpretation given by the Common Court of Justice and Arbitration (CCJA).The study based on the Ivory Coast case postulates the survival of the prohibition to enforce drawn from the erroneous interpretation of the community text and critizes the position of the CCJA because, notably, of the difficulty, on the one hand, to formulate this abrogation and, on the other, the incertainty and the contradiction of these solutions in each specific case.
